CLIENT AGREEMENT/TERMS & CONDITIONS

PARTIES

Client- Anyone seeking the travel services offered by Black Travel Fest.
Company- Black Travel Fest, a company organized and existing in the country of United States, for the purpose of delivering travel services.

CANCELLATION AND RESCHEDULING POLICY

We understand that sometimes travel plans need to be changed. We want to ensure that you have a clear understanding of our cancellation and rescheduling policy before booking your trip with us. A cancellation request can only be processed after a written confirmation is received. Please note that all clients will be provided a refund schedule and rebooking policy from Black Travel Fest within seven (7) days of booking.

Days to the trip start date will be calculated by adding the number of days from the current date at time of refund request to the day prior to the trip start date.

For example If the trip start date is August 31st:

the trip would be fully refundable from June 2nd to July 2nd
the trip would be 50% refundable from July 3rd to July 31st
the trip would be non-refundable starting August 1st

Please note: PayPal processing fees and vendor transaction fees will not be refunded.

. Rescheduling Policy:
Please note that rescheduling is subject to availability and must be within one year of the original departure date. The trip can only be rescheduled once. If the rescheduled trip cost is more than the original trip cost, the traveler is responsible for paying the difference.

Days to the trip start date will be calculated by adding the number of days from the current date at time of reschedule request to the day prior to the trip start date.

For example If the trip start date is August 31st:

the trip would be rescheduled with a processing fee of 5% from July 3rd to July 17th
the trip would be rescheduled with a processing fee of 10% from July 18th to July 31st
the trip would be rescheduled with a processing fee of 20% from August 1st to August 15th

We highly recommend purchasing travel insurance to protect yourself from unforeseen circumstances that may arise before and during your trip.

Please note that our cancellation and rescheduling policy is non-negotiable.

OTHER TERMS & CONDITIONS

Prices given to clients are based on the number of people in the travel party.
Smaller groups have a higher price per person.
If the number of people in a party decreases after booking, the price will be reassessed at the appropriate per person price point.
Travel packages are curated by Black Travel Fest and are not customizable.
Communication with Black Travel Fest is available via email and virtual support (Telephonic support is not available).

. FORCE MAJEURE

In the event that any Party hereto is delayed or hindered in the performance of any act required herein by reason of strike, inability to procure materials, failure of power, restrictive governmental law or regulations, riots, insurrection, war or other reasons of a like nature not the fault of such Party, the performance of such act shall be excused for the period of the delay. If the delay exceeds 30 days, then funds shall be refunded if possible or credit given if refund is not possible.

LEGAL COMPLIANCE

Client is required to treat all company employees, customers, clients, business partners and other affiliates of the Company with respect and responsibility. Client is required to comply with all local laws, ethical codes and company policies, procedures, rules or regulations, including those forbidding sex harassment, discrimination, and unfair business practices.

BREACH OF AGREEMENT

Violations by Client of this agreement will result in penalties decided by Company. These penalties include, but are not limited to client being prohibited from booking future experiences.

REPRESENTATION

Each party of this Agreement acknowledges that no representations, inducements, promises or agreements, orally or otherwise, have been made by any party hereto, or anyone acting on behalf of any party hereto, which are not embodied herein, and that no other agreement, statement or promise not contained in this Agreement shall be valid or binding. Any modification of this Agreement shall be effective only if it is in writing, signed and dated by all parties hereto.

INDEMNIFICATION

Client shall defend, indemnify, hold harmless, and ensure Company from any and all damages, expenses or liability resulting from or arising out of, any negligence or misconduct on Client’s part, or from any breach or default of this Agreement which is caused or occasioned by the acts of Client. Client shall insure that it takes all actions necessary to comply with the terms and conditions set forth in this Agreement.

CONTAINMENT OF ENTIRE AGREEMENT

This Agreement is an independent document and supersedes any and all other Agreements, either oral or in writing, between the parties hereto.

GOVERNING LAW

This Agreement shall be governed by, and construed under, the laws of Texas in the UNITED STATES.

By agreeing to these terms, the client acknowledges that he/she has reviewed and fully understands the terms and conditions of this Agreement. Client hereby agrees to all above terms, conditions, and policies.
